    Whiplash how to claim?

"I have been in your situation an didnt claim, i was treated in hospital , my employer paid me but i have a sore back as a recurrance ( infact i had an operation on it too to try help ) however i didnt claim for the pain i am in now as it was what it was ...an accident, it happens , i am entitled to a blue badge aswell that i dont have but it all comes down to not being labelled a chancer as they are out there, claims, badges, privelidges should be reserved for people who really deserve them, people with life changing injuries, accessibility issues etc ....but that is just my opinion, there are more opinions out there than hot dinners, doesnt make them all right The difference tho is you are not getting paid so that alone is something you should chase and have your wages re imbursed, can t see an issue with that" Do you not regret not claiming now? considering now you may have this back pain for life and may even impair your quality of iiving in later life? Im not sure if you have a good pension scheme or have money in property, unfortunately I only have a small pension and cannot buy as I dont have £1000's saved for a deposit, so anything which will help for the future, especially in the midsts of the current economic down turn is a bonus no? Im no chancer I've worked since I was 16 always paid my taxes, never claimed any hands outs from the goverment, abide by the laws of the land and life is still difficult, the chancers get everything, if you follow what society says then you lose out, dont get me wrong I'm not saying undertake any criminality I dont endorse that, I'm saying I believe these opportunities to claim what you can because your entitled to, are to be grabbed with both hands, because these opportunity's are few and far between! normally the good guy loses out. I mean I'm not breaking the law am I ? And who's to say if this injury wont impair my state of living for the rest of my life? I'm not taking any chances, I will claim and I dont believe that the insurance increase will be any different from what I would get anyway?

    Whiplash how to claim?

"A right to claim has nothing to do with premiums paid or a previous blame free record. It's all about whether you have suffered a genuine injury due to the negligent act of another person, that could have been avoided had that person fully taken into account their duty of care" I understand this Kris that the right to claim has nothing to do with premiums paid or a blame free record I just feel that this country embraces fraudsters. I have suffered a genuine injury, I will not get paid for my time off so why should'nt I claim? "If you feel you have a genuine injury and that you have suffered a genuine loss then I'd suggest looking at the Solicitors Regulatory Authority website as they will have a list of solicitors in your area who meet their criteria and will be able to act for you. Which solicitor you use is your decision but its very worthwhile understanding what any contract you enter into with the solicitor obliges you for. As for the accident management companies such as claims direct etc ..avoid them like the plague." And yes this is the type of advice I was requesting in the 1st place, thanks you Kris

My insurance goes up every year anyway? my renewel this year was £900 more than last year, of course I managed to get that down a bit so what real difference is it going to make?

    Whiplash how to claim?

My employee use a "Bradford scoring system" which you may or may not be aware of, which tallys up points whenever you have days off within a 6 months period. I had a lot of time off last year, some paid some unpaid, due to my partner and I going through IVF treatment which was unfortunately unccessful. Due to the amount of time I had off last year and one sick day I had around October time, I will not get paid for this time off, as its deemed I have gone over my allocated "score" this year, so this is one reason I'm claiming and the other, well to be brutally honest because I can!!. Well if so many people who have falsly claimed in the past and got away with it, why cant I genuinely claim? I wonder how many people on this forum has ever claimed falsly or honestly whiplash?, I would like to hear from someone who has. You say about the insurance companys seeing me as a liability, I personally think Insurance comapnys are robbing barstewards anyway, so maybe there is a part of me who wants to stick it to the man, and what difference is my claim going to make to overall scheme of things? fuel prices, insurance and the cost of living all going up, why should'nt I get some money back? On another topic but staying on theme, I got clamped about 3 weeks ago for parking in a car park at 10.45pm that was'nt signposted properly, and was charged £250 for removal of the clamp.....I was gone 10mins!!!....I know it has nothing to do with this but I think for every action there is a re-action, or something like this? Newton law ...I think??? Call it what you wil,l I would challenge anyone who was in my situation, not to claim!

    Whiplash how to claim?

To tell you the truth the thought did'nt even cross my mind, perhaps I'm naive? All Sunday (the next day) I was fine, it was only on the Sunday evening that I started to get a major headache, no back or neck pains at all. That night my father in law called to see how I was and he suggested that I may have whiplash, I said it could'nt be because I felt fine bar the headache. That night I did not sleep very well at all and when I finally woke up the next day I woke up with a neck ache, sowith what my father in law was saying to me the night before, I decdided to call the Doctor's after I called work. The Doctor examined me and confirmed I had whiplash, she explained that I should not drive, and signed me off for 2 weeks, which I thought was a bit excessive, but she also explained that in some cases the pain will become worse over the following week, I though it was only a neck/head ache pain, but over the past 3 days the pain has got worse and has also spread to my lower back and on a couple of ocassions when I've tried to get up I have felt dizzy, so you tell me if I have not got a case? I understand what your saying about people that claim whiplash and how it affects all of the legally paying driving public, as I always believed like you this whiplash lark was just a con, people just trying to get a quick buck, but after 4 days I truly believe I have a serious case of whiplash. Unfortunately for me though it seems that due to all the people that have falsly claimed whiplash before, when you do have a serious claim people will automatically believe it false, well I'm going to claim and well see what happens, watch this space.

    Whiplash how to claim?

Well I have been signed off for 2 weeks and was told that I cannot drive (which I do for a living). So I know I said "I have suffered whiplash" but Im still suffering as my back and neck are getting worse, this was NOT my fault the guy rammed into me, I could'nt even open the door when I tried to get out!! I understand the effect all these whiplash claims have on the insurance premiums, but that is not a false claim its genuine, and why the hell should'nt I claim?, I have got 6 years NCB with a totally clean driving license and have been driving for more than 20 years without ever claiming on any accident EVER!! so I think I'm well entitled to claim. To think of all the money I've paid over the years, and my renewel this year was quite frankly ridiculous!!! So sorry about the rant but if this had happened to you and you were genuinely suffering I think it would be a different story, I really was really asking if anyone had any pointers on how to claim, because I will claim as I've never done this sort of thing before and as the ad says "I think I'm entitled"
